SECTION 20 CONSULTATION INDUSTRY SURVEY

IMPORTANT ISSUE AFFECTING ALL BLOCKS OF FLATS AND THEIR MAJOR WORKS PROGRAMMES

Introduction

In 2014 the Competitions and Markets Authority (CMA) in its market study into residential property management services, recommended that the Department for Communities and Local Government (DCLG) should review the Section 20 consultation process, with a view to improving its operational effectiveness.

ARMA has taken the lead on this review and hosted two meetings with representation from our members, industry stakeholders, and which DCLG were also in attendance.


The proposal

The value of the current threshold of £250 has quite possibly been eroded by inflation and the increase in the VAT rate so that Section 20 consultation is now triggered for relatively minor and routine works. This situation is worse for very small blocks and it also means that the legislation may not work as intended on large blocks where very significant sums can be spent before the threshold kicks in. Additionally, lessees can become frustrated with the formal process and any associated delays and costs.


The aim of the review is to achieve a balance between protecting leaseholders and raising the threshold that triggers consultation to a more effective level so that the number of Section 20 consultations are reduced but the protection to lessees remains high.

Carlton Property Management is proud to be one of the first residential managing agents in England and Wales to have achieved ARMA-Q accreditation – the new regulatory regime for residential leasehold managing agents. 

ARMA-Q is designed to raise standards and quality of service across the residential leasehold management sector.  Despite collecting over a billion pounds in service charges from leaseholders each year, managing agents are not regulated by government.  Unless they are members of a professional body, agents are unaccountable, which leaves the system open to abuse and inconsistent service levels.
